Wortley in the City of Leeds Gentleman.
1. I APPOINT my son Albert
Dixon my grandson Mark Dixon and my friend William Bateson of Leeds aforesaid
Solicitor (hereinafter called "my Trustees") to be the Executors and
Trustees of this my Will.
2. I GIVE all my plate linen
china glass books pictures furniture and other household effects unto my son
the said Albert Dixon absolutely.
3. I GIVE the following
pecuniary legacies free from legacy duty namely:-
TO my sister Sarah Norwood
the sum of two hundred pounds.
TO Annie Dixon the widow of
my late son William Roberts Dixon the sum of one hundred pounds.
TO my late wife's sister
Emma Lofthouse provided that she shall be living at the date of my death the
sum of one hundred pounds.
TO Clarence Shaw Thornton
Howe the sum of fifty pounds.
TO the said William Bateson
the sum of fifty pounds.
TO Nellie Dixon the widow of
my late son James Dixon the sum of one hundred pounds.
TO my friend James Heslop of
14 Fearnley Street Wortley aforesaid the sum of twenty five pounds.
4. I GIVE one thousand two
hundred ordinary shares of one pound each in the company known as The Leeds
Consumers Ice and Cold Storage Company Limited to my said son Albert Dixon
absolutely and three hundred of such shares in the same company to the said
Clarence Shaw Thornton Howe
absolutely both such gifts
to be free from legacy duty.
5. I GIVE DEVISE BEQUEATH
AND APPOINT all the rest residue and remainder of my estate both real and
personal unto my Trustees UPON TRUST to sell call in and convert into money the
same or such part thereof as shall not consist of money and with and out of the
moneys produced by such sale calling in and conversion and with and out of my
ready money to pay the before mentioned legacies my funeral and testamentary
expenses and debts all death duties and the costs of proving this my will and
the expenses incidental to the realisation of my estate AND shall stand
possessed of the clear residue thereof UPON TRUST to divide the same into two
equal parts or shares AND as to one of such equal parts or shares I GIVE the
same to my son Albert Dixon absolutely AND as to the other of such equal parts
or shares I GIVE the same to my grandson the said Mark Dixon and my
granddaughter Doris Davies absolutely and in equal shares.
6. PROVIDED ALWAYS that if
any or either of them my said son Albert Dixon and my said grandson and
granddaughter the said Mark Dixon and Doris Davies shall die in my lifetime
leaving issue who shall attain the age of twenty one years then and in such
case such issue shall take and if more than one equally between them the share
which his her or their parent would have taken if such parent had survived me.
7. I DECLARE that my
Trustees may postpone the sale calling in and conversion of any part of my real
and personal estate for so long as they shall think fit and that the rents
profits and income to accrue from and after my decease of and from such part of
my estate as shall for the time being remain unsold and unconverted shall after
payment thereout of all incidental expenses and outgoings be paid and applied
to the person or persons and in the manner to whom and in which the income of
the proceeds of such sale and conversion would for the time being be payable or
applicable under this my Will if such sale and conversion had been actually
made.
8. AND IT IS MY DESIRE that
the said William Bateson who is my solicitor shall continue to act as such in
all matters relating to my property and affairs and shall make the usual
professional charge AND I DIRECT that he shall notwithstanding his acceptance
of the office of Trustee and Executor of this my Will and acting in the
execution thereof be entitled to make the same professional charges and to
receive the same pecuniary emoluments and remuneration for all business done by
him and all attendances time and trouble given or bestowed by him in or about
the execution of the trusts and powers of my Will or the management and administration
of my trust estate both real and personal as if he had not been a Trustee or
Executor but had been employed by my Trustees as their Solicitor and he shall
be entitled to retain out of my trust/estate or be allowed by and to receive
from his Co-Trustees out of the same estate the full amount of such charge
any rule of equity to the contrary notwithstanding.
AND LASTLY it is my wish and
desire that my remains shall be cremated.
